The Belle Plaine City Council met on June 3, 2018 at 6:00 p.m. in the council chambers with Mayor Dave Fish presiding. Present:  Mark Tegeler, Mitch Malcolm, Mary Pech and Andy Neuhaus.  Absent:  Judy Schlesselman.  Also present:  City Administrator Jeff Horne, Assistant City Attorney Gage Kensler and City Clerk Jacki McDermott.  The Pledge of Allegiance was recited.

Motion by Pech to approve the Consent Agenda, the Council Minutes of May 20, 2019, receiving and filing of the minutes from the Belle Plaine Community Library Board of Trustees meeting of May 28, 2019, and bills received, seconded by Malcolm.  On roll call vote, all voted Aye, motion carried.

The mayor opened the animal hearing dealing with a municipal infraction of Chapter 57 of Belle Plaine City Code.  The animal owner was not present and it was explained to the Council that they are not dealing with the ticket the owner was issued, but rather with whether the dog would be declared a vicious animal and sent out of town.  Since they did not appear, the City Administrator was directed to send a letter to the owners to explain that they should come to the June 17th Council meeting and until that time, the dog should be restrained at all times, and to send them a copy of the ordinance.  

A public hearing was held regarding the vacation of the alley located at “the North-South Alley lying North of 11th Street between 1st Avenue and Second avenue, adjoining Lot Five (5) in Blossom’s Second Addition to Belle Plaine Iowa,” which deals with the property at 110 11th Street.  No one appeared for or against the vacation.  Pech made a motion, seconded by Malcolm to approve Resolution 19-06-02, a resolution approving a Quit Claim deed for the property.  On roll call vote, all voted Aye, motion carried. 

Malcolm made a motion, seconded by Neuhaus to approve the Belle Plaine Community Development Corporation request to close 12th Street between 7th and 10th Avenues and those corresponding side streets off 12th Street on July 3rd from 12:00 p.m. until 12:30 a.m. on the 4th of July for the annual car show and street dance.  On roll call vote, all voted Aye, motion carried. 

Tegeler made a motion, seconded by Neuhaus to approve the Belle Plaine 4th of July committee request to close 12th Street between 7th and 12th Avenues from 9:00 a.m. to 11:30 a.m. for the 4th of July parade.  On roll call vote, all voted Aye, motion carried. 

Neuhaus made a motion, seconded by Tegeler to approve the request from Grand Central Station for outdoor service on July 3rd and 4th during the car show and street dance.  On roll call vote, all voted Aye, motion carried. 

Malcolm made a motion, seconded by Neuhaus to approve the request from the Oasis for outdoor service on July 3rd and 4th during the car show and street dance.  On roll call vote, all voted Aye, motion carried. 

Neuhaus made a motion, seconded by Malcolm to approve the request from the Office for outdoor service on July 3rd and 4th during the car show and street dance.  On roll call vote, all voted Aye, motion carried. 

Tegeler made a motion, seconded by Neuhaus to approve the Belle Plaine 4th of July Committee for a Class B Beer Permit (including wine coolers) and outdoor service for use at Franklin Park.  On roll call vote, all voted Aye, motion carried. 

Tegeler made a motion, seconded by Malcolm to approve the Belle Plaine 4th of July Committee annual fireworks show at Franklin Park (under the supervision of the Belle Plaine Director of Pyrotechnic Displays).  On roll call vote, all voted Aye, motion carried. 

Motion by Pech, seconded by Tegeler, to approve Resolution 19-06-01:  a resolution approving cost of living adjustment (C.O.L.A.) for non-bargaining group employees. On roll call vote, all voted Aye, motion carried.  

Motion by Pech, seconded by Malcolm to approve the first reading of Ordinance #87:  raising the water rate to $6.58 for the first thousand gallons and $6.58 per additional thousand gallons in town and $8.42 for the first thousand gallons and $8.42 per additional thousand gallons outside the city. (A raise of $.60 per thousand gallons of water.)  On roll call vote, all voted Aye, motion carried.  

Motion by Pech, seconded by Malcolm to approve the first reading of Ordinance #99:  raising the sewer rate to $10.56 for the first thousand gallons of water used and $10.56 per additional thousand gallons of water used. (A raise of $.31 per thousand gallons of sewage.)  On roll call vote, all voted Aye, motion carried.  

City Administrator, Jeff Horne, told the council that a sample has been submitted from Well #6 and they will have a meeting to discuss the results.  The City will be placing an ad to hire a custodian for 10-12 hours a week for City Hall and the Library.  Matt Kressly will be working on the computer network in City Hall next week.  Also the phones will be replaced in City Hall.  

Mayor Dave Fish reported that the Landfill Commission asked the Benton County Board of Supervisors to rescind the Benton County Recycling Ordinance.  He also reported that Benton Development Group is working on their budget and that Director Kate Robertson will be bringing in the Belle Plaine video for Council to view.  The mayor will be going to six four hour interviews for the position of director of ECICOG.

Motion by Tegeler to adjourn the meeting, seconded by Neuhaus.  On roll call vote, all voted Aye, motion carried.  Meeting adjourned at 6:51 p.m.
