City Council Special Meeting Work Session

Mayor Visser called the meeting to order at time 6:02 p.m. Present were DeMeulenaere, Koehn, Petersen, and Steffen. Also present were City Attorney- Eric Martin, and members of the public. Bell joined the meeting at 6:06 pm.

The council held discussion regarding the Fiscal Year Ending 2023 Budget amendment and reviewed published notice of public hearing document.
The council held discussion regarding the Council Policies and Procedures document in draft form. Continuing from May 22, 2023 work session. Markups were discussed to be incorporated into the document for presentation to council for consideration and approval.
There being no further business, the Mayor declared meeting adjourned at 8:32 p.m.

Budget Amendment – Fiscal Year Ending 2023 (FYE 23) Public Hearing opened at 6:48 p.m. Clerk informed no written or verbal statements have been received for or against the budget amendment. There being no comments Mayor Visser closed the public hearing 6:50 p.m.
Steffen moved to approve Resolution 2023-06-01 a resolution adopting FYE 2023 Budget Amendment. Koehn seconded. Aye: Bell, DeMeulenaere, Koehn, Petersen, and Steffen. Motion carried.
Koehn moved to approve the 3rd Reading and finally approval of Ordinance No. 228 Amending the Code of Ordinance of the City of Atkins, Iowa, 2005, by amending the provisions pertaining to Solid Waste Service Charges. Steffen seconded. Aye: Bell, DeMeulenaere, Koehn, Petersen, and Steffen. Motion carried.
Koehn moved to approve the 2nd Reading of Ordinance No. 229 Amending the Code of Ordinance of the City of Atkins, Iowa, 2005, by amending the provisions pertaining to Sewer Service Charges. Petersen seconded. Aye: Bell, DeMeulenaere, Koehn, Petersen, and Steffen. Motion carried.
Koehn moved to approve Resolution 2023-06-02 Letter of engagement for legal services regarding General Obligations Corporate Purpose Bonds, Series 2023. Steffen seconded. Aye: Bell, DeMeulenaere, Koehn, Petersen, and Steffen. Motion carried.
Koehn moved to approve Resolution 2023-06-03 setting the date for public hearing on proposal to enter into General Obligation Corporate Purpose Loan Agreement and to borrow money thereunder in a principal amount not to exceed $450,000. Steffen seconded. Aye: Bell, DeMeulenaere, Koehn, Petersen, and Steffen. Motion carried.
Koehn moved to direct staff to proceed with Water Tower and Distribution System Project(s). Bell seconded. Aye: Bell, DeMeulenaere, Koehn, Petersen, and Steffen. Motion carried.
City Hall hours are Monday – Thursday 9 a.m. to 3 p.m. and closed on Fridays. Mayor Visser informed the hours worked will not change, staff needs to have time to focus.
Mayor Visser an overview of the laws and rules the City must follow. Mayor listed several Federal, and State agencies and laws the city is mandated to comply with in addition to the City’s ordinances, contracts, resolutions, and policies.
Mayor Visser mentioned several trainings opportunities for City Council.
The council discussed ways to make council meetings available to public. Currently,
meetings are available via Webex.
Mayor Visser members of the public requested time to speak regarding the notice of non-renewal of the city administrator’s contract. Mayor called requesters’ names, Ryan Hosch was present in summary discussed council’s responsibility to keep city operational believing council is acting irresponsibly.
Bell moved to Reconsideration of Resolution 2023-05-06 Approving issuance of written Notice of non-renewal of Employment Agreement to the City Administrator consistent with terms of City Administrator Employment Agreement, to override Veto by Mayor Visser on May 19, 2023. Motion died due to a lack of a second.
Mayor’s Report: Completed fraud training with office of inspection general.
Administrator’s Report: The Parks and Open Space Plan kick off meeting with staff was held. The Fiscal Year End 2022 Audit continues. Finalizing Fiscal Year Ending 2023. Continue to work with audit results.
Public Works: Several meetings with contractors and DNR with the inspections completed this summer. Contractors are on site: the Water Treatment Plants Scrubber replacement, A Avenue Storm Tube Repairs, and Waste Water Treatment Lift Station Maintenance. The contractor for Chip Sealing roads plans to be on site soon.
Council Reports: none.
Public input: Citizen discussed notice to public regarding construction and quoted work
study regarding the cost of interruptions.

Petersen moved to approve 3rd reading and Final Adoption of Ordinance No. 229 Amending the Code of Ordinance of the City of Atkins, Iowa, 2005, by amending the provisions pertaining to Sewer Service Charges. Steffen seconded. Ayes: Bell, DeMeulenaere, Koehn, Petersen, and Steffen. Motion carried.
Mayor opened public hearing on proposal to enter into an Essential Purpose Loan Agreement at 6:39 p.m. There being no written or verbal comments for or against Essential Purpose Loan, the mayor closed the public hearing at 6:41 p.m. Kohn moved to approve Resolution 2023-06-04 taking additional action on proposal to enter into an Essential Purpose Agreement and combining Loan Agreements. Steffen seconded. Ayes: Bell, DeMeulenaere, Koehn, Petersen, and Steffen. Motion carried.
Water Tower and Distribution System Project(s) workshop to be set.
Koehn moved to approve Resolution 2023-06-05 Change Order No. 1 in the amount of $6,523 for the A Avenue Culvert Repairs. Petersen seconded. Ayes: Bell, DeMeulenaere, Koehn, Petersen, and Steffen. Motion carried.
Koehn moved to approve Resolution 2023-06-06 Pay Request No. 1 in the amount of $60,074 to Ken-Way for the A Avenue Culvert Repairs. Steffen. Ayes: Bell, DeMeulenaere, Koehn, Petersen, and Steffen. Motion carried.
Mayor’s Report: City has completed updating its Federal Unique Identifier and activated it. City has received initial FEMA payment for the debris and fire station. FEMA had obligated the fire station to allow the project to move forward. The city continues to work through fiscal year ending 2022 audit.
Public Works Report: Water Plant – Scrubber repairs are 80% complete. 2023 Street Maintenance work of chip sealing and striping have been completed. Contractor will begin July
5th to clean and televise sewer lines in phase 1 and 2. The A Avenue Culvert repairs are complete. The city is working to respond to Iowa Department of Natural Resources report regarding the water system. City is working to complete sanitary sewer systems annual permit
process. Public Works is preparing for Watermelon days.
Administrator’s Report: Auditor will be on-site starting July 5 to complete field work for the FYE 2022 Audit. Auditor is estimating two weeks for the audit. Completing the FYE 2023 procedures and verifications processes, as well as the monthly, quarterly, and yearly reporting. Continue to work with prospective economic development opportunities.

Bell: reported the ditch along Circleview
Dr. Koehn: requested City hire a temp during audit to assist office.
DeMeulenaere: Questions regarding several policies.
Public Input: Library board member Fiala discussed Library bills. Visser informed there are procedures and there has been communication. Citizen thanked council for everything they do. Question regarding green space near Railroad Street. The Next Regular Council Meeting to be held Tuesday, July 11, 2023, at 6:30 p.m. City Hall/Library 480 3rd Avenue, Council Room.
