City Council Meeting Regular Session
Tuesday, July 25, 2023, at 6:30 p.m.
City Hall Council Room, 480 Third Avenue, Atkins, Iowa, 52206
Mayor Bruce Visser called the meeting Time 6:30 p.m. Present: Bell – Online, DeMeulenaere –
Online, Koehn, and Petersen. Absent: Steffen.
Koehn moved to approve the agenda. Petersen seconded. Ayes: Bell, DeMeulenaere, Koehn,
and Petersen. Nays: None. Absent: Steffen. Motion carried.
Bell requested consent agenda items; 3b. Renewal: Atkins Family Pharmacy Special Class B Native Wine License (WBN), 3c. Resolution 2023-07-01 A Resolution approving the 2023 Fire
Department Roster, 3d. Resolution 2023-07-03 A Resolution approving Kiddie Parade Street
Closure, 3e. Resolution 2023-07-04 A Resolution approving 5K Walk Run Street Closure, 3f.
Resolution 2023-07-05 A Resolution approving Watermelon Day Parade Route, be removed
from the consent agenda items and be voted on separately. Mayor Visser announced the items
3b, 3c, 3d, 3e, 3f would be removed from the consent agenda as requested and the items would be voted on individually after the remaining consent agenda items are considered.
Koehn motioned to approve consent agenda items 3a Approve Council Minutes of July 11 and
June 13, 2023 Special Session and item 3g. List of Bills for Approval. Petersen seconded.
Ayes: Koehn and Petersen. Nayes: DeMeulenaere, Bell. Motion Failed. DeMeulenaere
questioned why the list of bills were received this afternoon. Staff members were at training last week.
Koehn moved to approve item 3b, the renewal of Special Class B Wine License (WBN) for
Atkins Family Pharmacy. Bell seconded. Ayes: Bell, DeMeulenaere, Koehn, and Petersen.
Motion carried.
Koehn moved to approve item 3c, Resolution 2023-07-01, a Resolution approving the Atkins
Fire Department Roster. Petersen second. Ayes: Bell, DeMeulenaere, Koehn, and Petersen.
Nays: None. Absent: Steffen. Motion carried.
Koehn moved to approve item 3d, Resolution 2023-07-04 a Resolution approving the 5K
walk/run street closure for August 5, 2023, Watermelon Days. Petersen second. Ayes: Bell,
DeMeulenaere, Koehn, and Petersen. Nays: None. Absent: Steffen. Motion carried.
Koehn moved to approve item 3e, Resolution 2023-07-05, a Resolution approving the Parade
Route for August 5, 2023, Watermelon Days. Bell second. Ayes: Bell, DeMeulenaere, Koehn,
and Petersen. Nays: None. Absent: Steffen. Motion carried.
Koehn moved to approve item 3f, Resolution 2023-07-02, a Resolution granting Park Soccer
Field Reservation to the BYSA for August 28, 2023. BYSA will need insurance or a waiver of
indemnity. Bell second. Ayes: Bell, DeMeulenaere, Koehn, and Petersen. Nays: None.
Absent: Steffen. Motion carried.
Mayor’s Report: Deputy Clerk Breese attended required training Iowa Professionals
Institute summer session July 17-20, 2023, Audit for FYE 2022 is ongoing, signed off on
FEMA funding for category Z administrative cost approved $57,000.
Public Works: Water Plant work continues; Water tower improvements will begin in
August along with Plant system upgrades. Preparing parks and streets for Watermelon
Days.
Administrator’s Report: Working on FYE 2023 audit and Annual Reports.

Mayor Bruce Visser called the meeting to order at 6:30 p.m. Present: Bell, DeMeulenaere,
Koehn, Petersen, and Steffen. Also present were; Holly Corkery – City Attorney, and Amy
Breese – Deputy Clerk. Absent: Kelly Groskurth City Administrator.
Koehn motioned to approve the agenda. Petersen seconded. Ayes: Bell, DeMeulenaere, Koehn,
Petersen, and Steffen. Motion carried.
Koehn motioned to approve the Consent Agenda. Petersen seconded. Ayes: Bell,
DeMeulenaere, Koehn, Petersen, and Steffen. Motion carried. Consent agenda was as follows:

Koehn motioned to approve Resolution 2023-08-01 Approving Payment of Claims. Petersen
seconded. Ayes: Bell, DeMeulenaere, Koehn, Petersen, and Steffen. Motion carried.
Steffen motioned to approve appointment of Dick Lange to City of Atkins Planning & Zoning
Commission. Koehn seconded. Ayes: Bell, Koehn, Petersen, and Steffen. Nays: DeMeulenaere.
Motion carried.
Mayor’s Report: Fire station rebuild continues, working on funding, bonding, bid documents,
and FEMA debris cleanup funding. Public works assisting with design on the fire station. Water
system improvements begin in August. Watermelon Days was a success thank you to the
Community Club for organizing it. Water billing implementation to read the new meters is in
process. Audit is still ongoing and other legal matters. Iowa League of Cities statewide training
conference upcoming in September for all city staff, council, and mayor.

Koehn: Fire Station timeline.
Bell: Water tower project.
Public Input:
Katie Bauder, Atkins, utility billing. City hall will follow up.
Dave Duball, Atkns, discussed incident at City Hall. Mayor Visser provided information.
Dennis Taschner, Atkins, public safety report.
Koehn motioned to move into Closed Session. Petersen seconded. Mayor Visser called for
attorney opinion, Corkery stated that she has reviewed Iowa Code section 21.5(1)(c) and finds it appropriate to enter closed session to discuss strategy with counsel in matters that are presently in litigation or where litigation is imminent where its disclosure would be likely to prejudice or disadvantage the position of the governmental body in that litigation. Ayes: Bell, DeMeulenaere, Koehn, Petersen, and Steffen. Motion carried. Mayor Visser requested the public to clear the council chambers to prepare for closed session. A pause occurred for technology setup and to prepare for closed session occupied 12 minutes. No discussion or Council action was taken during the pause. Council moved into closed session.
Meeting resumed in regular session at 8:19 p.m. from closed session.
Next regular council meeting to be held Tuesday, August 22, 2023, at 6:30 p.m. City
Hall/Library 480 3rd Avenue, Council Room.
Koehn motioned to adjourn. DeMeulenaere seconded. Ayes: Bell, DeMeulenaere, Koehn,
Petersen, and Steffen. Motion carried. 8:21 pm.
