Belle Plaine, Iowa

The Belle Plaine City Council met in Special Session on March 20, 2020, at 5:31 p.m. in the council chambers with Mayor Dave Fish presiding. Present in person or by conference call were: Mary Pech, Judy Schlesselman, Mitch Malcolm, Garrett Landuyt, and Mark Tegeler. Also present: City Attorney Jennifer Zahradnik, City Administrator Stephen Beck, City Clerk Jacki McDermott and Assistant City Clerk Sandy Walton. The Pledge of Allegiance was recited.
Motion by Tegeler, seconded by Pech to approve the agenda. On roll call vote, all voted Aye, motion carried.
Motion by Schlesselman to enter into closed session regarding a settlement on the Wastewater Treatment Plant per Iowa Code 21.5 (1) (c): to discuss strategy with counsel in matters that are presently in litigation or where litigation is imminent where its disclosure would be likely to prejudice or disadvantage the position of the governmental body in that litigation, seconded by Malcolm, at 5:34 p.m. On roll call vote, Tegeler, Malcolm, Pech, Landuyt and Schlesselman all voted aye. Motion carried. The minutes and the tape recording of the closed session will be available for public examination when the transaction discussed is completed.
Motion by Schlesselman, seconded by Landuyt to come out of closed session at 5:47 p.m. On roll call vote, Malcolm, Pech, Tegeler, Landuyt and Schlesselman all voted aye. Motion carried.
Motion by Malcolm, seconded by Pech to give the city attorney and mayor direction to deal with litigation. On roll call vote, all voted Aye, motion carried.
Motion by Tegeler to adjourn the meeting, seconded by Landuyt. On roll call vote, all voted aye. Meeting adjourned at 5:48 p.m.
