Atkins Proclamation – COVID-19

Subject: Emergency Proclamation regarding community spread of COVID-19
WHEREAS, COVID-19 poses a serious threat to the public health and safety of the City of Atkins,
Iowa, as outlined by the Center for Disease Control (“CDC”), and
WHEREAS, the Iowa Department of Public Health (“IDPH”) has now determined that community
spread of COVID-19 has occurred in the State of Iowa, and
WHEREAS, the CDC has recommended that people do not congregate in gatherings of over ten (10)
people to attempt to mitigate the spread of COVID-19 in the general public, and
WHEREAS, the Honorable Governor Kimberly Reynolds issued a Proclamation of Public Health
Disaster Emergency Proclamation to provide additional needed resources and measures to respond to this disaster and such public health disaster continues to exist, and
WHEREAS, Section l5.02(2) of the Code of Ordinances of the City of Atkins and Section

  1. 14(2) of the Code of Iowa (2019) grant the Mayor powers to declare an emergency and govern
    through proclamation to protect the health and safety of the citizens of Atkins.
    NOW, THEREFORE, I, Bruce E. Visser, the duly elected Mayor of the City of Atkins, Iowa, do hereby proclaim the following:
    1. That a state of emergency or public danger exists within the City of Atkins because of the threat of the spread of the COVID-19 virus.
    2. That based upon the advice of the CDC and other public health agencies, I declare that, Atkins City Hall and Public Library will be closed to the public beginning upon execution of this Proclamation. Staff will be on duty and be available to the public through email and phone calls. Correspondence by mail, package delivery, utility drop box, and Library drop box will be accepted.
    3. That based upon the advice of the CDC and other public health agencies, I declare that, Atkins Main Park pavilion, band shell and playground will be closed to the public beginning upon execution of this Proclamation.
    4. That based upon the advice of the CDC and other public health agencies, I declare that, Atkin Soccer Park pavilion kitchen, restrooms, and playground equipment will be closed to the public beginning upon execution of this Proclamation.
    5. That based upon the advice of the CDC and other public health agencies, I declare that, the Atkins Fire Station and grounds is closed to the public beginning upon execution of this Proclamation. Access to the facilities and operations by all Fire and EMS staff will be guided by the rules published by the Atkins Fire Chief for COVID-19.
    6. That based upon the advice of the CDC and other public health agencies, I declare that, meetings of the City Council, City departments, boards and commissions be held electronically, beginning upon execution of this proclamation. Meetings will be conducted pursuant to the Governors Proclamation of Disaster Emergency.
    7. That pursuant to the Governor’s Proclamation of Disaster Emergency, gatherings and events of more than 10 people are hereby prohibited at all locations and venues, including but not limited to parades, festivals, conventions, and fundraisers.
    8. That pursuant to the Governor’s Proclamation of Disaster Emergency, that salons and barbershops, tanning facilities, other nonessential retail establishments, senior citizen centers and adult daycare facilities in Atkins be closed.
    9. That pursuant to the Governor’s Proclamation of Disaster Emergency that all restaurants and bars in Atkins be closed, with the exception to allow food be served by can’y-out, drive-through or delivery.
    10. That this Proclamation supports all rules and orders and exceptions of the Governors Proclamation of Disaster Emergency.
      II. That based upon the advice of the CDC and other public health agencies, the City strongly recommends that citizens continue to practice social distancing, wash your hands regularly, staying home if you are sick, and comply with guidance issued by local, state, and federal authorities.
    11. That this Proclamation of Emergency may be modified and/or superseded by future
      proclamation of the Office of the Mayor of Atkins as future events warrant.
    12. That any violation of any proclamation of the Office of the Mayor of the City of Atkins, Iowa, shall be enforceable by the Benton County Sheriff and any violation of the same shall be a violation of Section l5.02(2) of the Code of Ordinances and punishable as a simple misdemeanor.
