Minutes of Atkins City Council Meeting
April 20th, 2020 Atkins, Iowa
Council met in Regular session. Members present by roll call via teleconference due to COVID -19 response were Heather Rinderknecht, Nathan Shepard, Lana Robison and Joey Svejda. Absent: Robert Spading. Also, present in person: Mayor Bruce Visser and Amber Bell City Clerk. Tom Gerhold, M.G., Nicole Roos, Nick Eisenbacher from Snyder & Associates and Ryan Tang City of Atkins City Attorney were also called on the
teleconference. Mayor Bruce Visser called the meeting to order at 7:00 pm.
Rinderknecht made a motion to approve the consent agenda for April 20th, 2020 Including:
City Council Minutes April 6th, 2020.
File: Engineers report dated April 20th, 2020.
File: Atkins Planning and Zoning Commission letter dated April 20th, 2020; Recommending
all the following: Creating an Amendment to Change the Zoning on the Future Land Use Plan
and Future Land Use Map. The Change would be rezoning lots 312 and 326 Parkridge Rd
from 10 RS to AC Commercial.
Authorizing Application for City Water System Operating Permit June 2020.
List of Bills for Approval.
The motion also tables two Consent Agenda Items that will be voted on separately later in this
meeting: Adopt Resolution 777 Agreement for Staging Area Lease at the WWTP and Adopt
Resolution 776 Annual Lease agreement with St Stephens Lutheran Church for the Lease of
the Baseball Field. Robison seconded to the motion. Ayes: Svejda, Rinderknecht, Robison
and Shepard. Nay: None. Absent: Spading. Motion carried.

No motion was made for the first tabled Consent Agenda Item. No Vote on Adopting
Resolution 777 Agreement for Staging Area Lease at the WWTP. Resolution 777 Agreement
for Staging Area Lease at the WWTP died for a lack of a motion.
Robison made a motion to table Consent Agenda Item to Adopt Resolution 776 Annual Lease
agreement with St Stephens Lutheran Church for the Lease of the Baseball Field. The motion
tables this item until the City can talk to St Stephens Lutheran Church and the leaders from the
baseball league. Rinderknecht seconded the motion. Ayes: Svejda, Rinderknecht, Robison
and Shepard. Nay: None. Absent: Spading. Motion carried.
The Council discussed The City of Atkins response to the COVID-19 Emergency and
Proclamation. The Council also discussed reviewing The City of Solid Waste and Recycling
contract. Shepard asked Attorney and Mayor for information concerning the mayor’s
proclamation of emergency. Mayor provided information as to why a proclamation is used.
Shepard read a statement asking that rights of citizens be considered.
The Council listened to concerns and had a discussion on pedestrians crossing 33rd Avenue.
This intersection is often crossed. This is a busy road with higher speeds. The council
discussed options to make this intersection safer.
Shepard left the meeting at 8:50 pm and returned at 8:52 pm. Shepard made a motion to table
approving City Street Lights for the Stoneridge Addition in Atkins, until more information is
available. Rinderknecht seconded the motion. Ayes: Svejda, Rinderknecht, Robison and
Shepard. Nay: None. Absent: Spading. Motion carried.
Svejda made a motion to table any action concerning City of Atkins Branding and Marketing.
Robison seconded the motion. Ayes: Svejda, Rinderknecht, Robison and Shepard. Nay: None.
Absent: Spading. Motion carried.
Rinderknecht made a motion to adopt Resolution 775 Approving a Purchase Agreement for
the Property (lot) at 619 High Point Drive, Atkins Iowa for Park Use. The Purchase
Agreement in for the amount of $44,000.00. Svejda seconded the motion. Ayes: Svejda,
Rinderknecht, Robison and Shepard. Nay: None. Absent: Spading. Motion carried.
Mayor Visser updated the council on new information on the Proposed City of Atkins City
Administrator position.
Rinderknecht made a motion to Set a Public Hearing to consider amending The City of Atkins
Budget FY July 1st, 2019 to June 30th, 2020, For May 18th, 2020 at 7:00pm. This will be held
at Atkins City Hall. Due to the declared State of Emergency the Public Hearing may be
conducted using teleconference. The Next Meeting Agenda will include instructions to access
the system. The motion was seconded by Shepard. Ayes: Svejda, Rinderknecht, Robison and
Shepard. Nay: None. Absent: Spading. Motion carried.
Shepard made a motion to Set a Public Hearing to consider amending The City of Atkins
Zoning Regulations 2016 Comprehensive Plan which includes the Future Land Use Map, For
May 18th, 2020 at 7:00pm. This will be held at Atkins City Hall. Due to the declared State of
Emergency the Public Hearing may be conducted using teleconference. The Meeting Agenda
will include instructions to access the system. The motion was seconded by Rinderknecht.
Ayes: Svejda, Rinderknecht, Robison and Shepard. Nay: None. Absent: Spading. Motion
carried.
Rinderknecht made a motion to Set a Public Hearing to consider amending The City of Atkins
Zoning Regulations to rezone 312 Parkridge Road and 326 Parkridge Road, Atkins, Iowa.
These would be rezoned from 10 RS Residential Single Family to AC Arterial Commercial.
The Public Hearing will be May 18th, 2020 at 7:00pm. This will be held at Atkins City Hall.
Due to the declared State of Emergency the Public Hearing may be conducted using
teleconference. The Meeting Agenda will include instructions to access the system. The
motion was seconded by Shepard. Ayes: Svejda, Rinderknecht, Robison and Shepard. Nay:
None. Absent: Spading. Motion carried.
Visser updated the Council on the Well # 2 Rehab Project and other Public Works Items.
The next Regular Council Meeting date for Monday, May 4th, 2020 at 7:00PM at Atkins City
Hall, 480 3rd Ave, Atkins. Due to the declared State of Emergency the Council meeting will
be conducted using teleconference. The Next Meeting Agenda will include instructions to
access the system.
Shepard made a motion to adjourn the meeting. Svejda seconded to the motion. Ayes: Svejda,
Rinderknecht, Robison, Spading and Shepard. Nay: None. Absent: None. Motion carried.
