COUNCIL: Keystone passes ordinances

CITY OF KEYSTONE COUNCIL PROCEEDING

May 7, 2020

The regular meeting of the Keystone City Council was held Thursday, May 7, 2020, at 6:00 pm. Roll Call members present: K.Janss and Kaiser; Behrens Kruse and Upah were in attendance via Zoom Video Conference. Absent: none. Also Present: Via Zoom Video Conference Rodney Kleitsch, Southlaw P.C., Dave Monson, City Superintendent, attended at the City Hall. Mayor, Erin Janss called the meeting to order.

Motion made by Behrens, second by Janss to approve the April 2020 minutes. Motion carried. All voted aye.

Motion made by Kaiser, second by Kruse to approve the April 2020 Treasurer Report. Motion carried. All voted aye.

Rodney Kleitsch, Southlaw P.C. discussed with the Mayor and Council One sealed bid was opened by Mayor Janss. Motion made by Kaiser, second by Upah to approve the sale of the 1972 Dump Truck.

Motion made by Kruse, second by Kaiser to approve the Liquor License Renewal for the Keystone Turner Hall. Motion carried. All voted aye.

Motion made by K.Janss, second by Behrens to approve Resolution 3-2-20, Designating Newspapers. Motion carried. All voted aye.

Motion made by Kaiser, second by Kruse to approve the Summer Rec Coaches for the Keystone Pony and Little League boys and girls. Motion carried. All voted aye.

Motion made by Kruse, second by Behrens to approve the First Reading of Ordinance 78 Raising the Water Rates and changing Temporary Discontinuance. Motion carried. All voted aye.

Motion made by Kaiser, second by Janss to approve the First Reading of Ordinance 79 Raising the Sewer Rates and changing Temporary Discontinuance. Motion carried. All voted aye.

Motion made by Behrens, second by Kruse to approve the First Reading of Ordinance 80 Raising the Garbage Rates and changing Temporary Discontinuance. Motion carried. All voted aye.

Motion made by Kaiser, second by Kruse to approve the First Reading of Ordinance 81 Changing the Dates for Yard Waste Pickup. Motion carried. All voted aye.

Motion made by Kruse, second by Behrens to observe May as National Preservation Month. Motion carried. All voted aye.

Motion made by Janss, second by Behrens to Proclaim April 24, 2020 as Arbor Day. Motion carried. All voted aye.

Motion made by Kruse, second by Upah to approve a building permit at 303 3rd Avenue to install an 8×10 storage shed. Motion carried. All voted aye.

Motion made by Janss, second by Behrens to approve the bills as read. Motion carried. All voted aye.

 ORDINANCE NO. 78 

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF KEYSTONE, IOWA, 2019, BY AMENDING SECTION 92.02 and ADDING SECTION 92.09 

Be It Enacted by the City Council of the City of Keystone, Iowa: 

SECTION 1. SECTION MODIFIED. Section 92.02 of the Code of Ordinances of the City of Keystone, Iowa, 2013, is repealed and the following adopted in lieu thereof: 

92.02 RATES FOR SERVICE. Water service shall be furnished at the following monthly rates within the City: 

(Code of Iowa, Sec. 384.84) 

1. Usage Charge. Gallons Used Per Month Rate 
First 1,000 $ 11.08 (minimum bill) 
All over 1,000 $ 4.80 per 1,000 gallons 

 ORDINANCE NO. 79 

AN ORDINANCE AMENDING CHAPTER 99 OF THE CODE OF ORDINANCES OF THE CITY OF KEYSTONE, IOWA, 2019. 

Be It Enacted by the City Council of the City of Keystone, Iowa: 

SECTION 1. SECTION MODIFIED. Section 99.06 and Section 99.07 of the Code of Ordinances of the City of Keystone, Iowa, 2019, is repealed and the following adopted in lieu thereof: 

COLLECTION FEES. Each user shall pay for the services provided by the City based on use of the treatment facilities as determined by water meters acceptable to the City and as described and set forth below. 

1. USAGE CHARGE 

Minimum Charge: $9.25 monthly for first 1,000 gallons for all users 

Additional Charge: $6.95 per each 1,000 gallons or fraction thereafter for all users. 

Vacation Charge: $9.00 monthly. 

2. DEBT REDUCTION FEE. In addition to the usage charge, each customer shall be charged a debt reduction fee of $45.00 per month. 

99.07 TEMPORARY DISCONTINUANCE. The minimum rate per month will apply for all occupied premises and unoccupied premises. All unoccupied premises where the water is turned off at the curb stop will be billed for the Debt Reduction fee of $45.00 only. Shut off of curb stops can only be completed by authorized City personnel. 

SECTION 2. SEVERABILITY CLAUSE. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. 

SECTION 3. WHEN EFFECTIVE. This ordinance shall be in effect from and after its final passage, approval and publication as provided by law.

 ORDINANCE NO. 80 

AN ORDINANCE AMENDING CHAPTER 106 OF THE CODE OF ORDINANCES OF THE CITY OF KEYSTONE, IOWA, 2019, BY AMENDING SECTION 106.08 and ADDING SECTION 106.10. 

WHEREAS, the City of Keystone wishes to amend the garbage rates set for commercial premises as they relate to the Garbage Rate and Tipping Fee. 

IT IS THEREFORE RESOLVED that the Keystone Municipal Section 106.08 is hereby amended as follows: 

SECTION 1. SECTION MODIFIED. Section 106.08 of the Code of Ordinances of the City of Keystone, Iowa, 2019, is repealed and the following adopted in lieu thereof: 

A. Residential Premises. Each dwelling unit and each unit of a multi-family dwelling (4-plex or below) shall pay $12.66 per month for a once a week pickup. Each residential unit and each multi-family dwelling unit hereunder shall also pay the sum of $6.16 per month for landfill fees. Each residential unit and multi-family dwelling unit hereunder shall also pay the sum of $3.00 per month for tipping fees. 

B. Commercial Premises. Each commercial business shall pay a monthly fee based upon the following formula: 

Landfill-$17.15 per dumpster per month 

Any apartment unit of greater than four units will be considered a commercial business. 

106.10 TEMPORARY DISCONTINUANCE. The minimum rate per month will apply for all occupied premises and unoccupied premises. All unoccupied premises where the water is turned off at the curb stop will be billed for the Landfill fee of $6.16 only.
