Minutes of Atkins City Council Meeting December 16, 2020 Atkins, Iowa

Council met in Special Session at St Stephen’s Lutheran Church, Fellowship Hall, 303 Third Ave, Atkins, Iowa, due to storm damage at Atkins City Hall. Members present in person were Robert Spading, Heather Rinderknecht, Nathan Shepard, and Lana Robison. Joey Svejda . Absent: None. Mayor Bruce Visser, present, Amber Bell City Clerk not
present, City Attorney Holly Corkery via teleconference. Public present; none. Mayor Bruce Visser called the meeting to order at 6:30 pm with a roll call.

Motion by Rinderknecht to approve the agenda. Second by Spading. Ayes: Svejda, Rinderknecht, Spading, Shepard, Robison. Nay: None. Absent: None. Motion carried.

Mayor Visser read a statement provided by City Attorney Kara Bullerman, “I have reviewed the proposed subject matter for the closed session and find the same to be appropriate under Iowa Code Section 21.5(1)(c).” Motion by Robison, second by Svejda to adjourn to closed session pursuant to Iowa Code Section 21.5(1)(c) to discuss imminent litigation. Ayes: Svejda, Rinderknecht, Spading, Shepard, Robison. Nay: None. Absent: None. Motion carried.

Council adjourned to closed session at 6:35 pm.

Council reconvened at 7:40 pm

Mayor Visser called for a motion for possible action related to the closed session. Hearing none, the matter died for a lack of motion. No action taken.

Mayor Visser called the meeting to order at 7:07 p.m. Present were Spading, Svedja, Robison, and Rinderknecht. Shepard was absent.

Spading moved to approve the Consent Agenda which includes the approval of List of Bills, Mayoral Proclamation 2020-12-1 continuing State of Emergency to April 30, 2021, City Engineer’s report dated January 18, 2021, Resolution 818 Approve Building code Official (Inspector) for the City of Atkins, Resolution 824 Approve Plat of Ridgeview Seventh Addition lot 2 to the City of Atkins, Resolution 825 Approve Plat of Stone Ridge First Addition Lot 25 to the City of Atkins, Resolution 821 Approve pay Application No 2 to Garling Construction of Belle Plaine, IA for storm repairs, and Resolution No. 820 to adopt City of Atkins SUDAS Supplemental Regulations, 2021 edition. Spading seconded. Ayes: Robison, Svejda, Spading, and Rinderknecht. Absent: Shepard. Motion carried.

Spading moved to demonstrate local support towards a Catalyst Grant Application for property located at 76 Main Avenue, Atkins, and intent to provide incentives. Svejda seconded. Ayes: Robison, Svejda, Spading, and Rinderknecht. Absent: Shepard. Motion Carried.

Robison moved to approve Resolution 823 Voluntary resignation agreement between the City and employee. Rinderknecht seconded. Ayes: Svejda, Spading, Rinderknecht, and Robison. Absent Shepard. Motion Carried. Svejda moved to approve resolution 822 approving purchase of Water Plant R/0 membrane replacement. Robison seconded. Ayes: Spading, Rinderknecht, Robison, and Svejda. Absent Shepard. Motion Carried.

Spading moved to approve provisional job offer for the Public Works I position. Rinderknecht seconded. Ayes: Rinderknecht, Robison, Svejda, and Spading. Absent Shepard. Motion Carried.

Spading moved to proceed to draft contract for continuing City Clerk Services. Rinderknecht seconded. Ayes: Robison, Svejda, Spading, Rinderknecht. Absent Shepard. Motion Carried.

Svejda moved to purchase replacement IT equipment for City Hall/Library Buildings. Robison seconded. Ayes: Svejda, Spading, Rinderknecht, and Robison. Absent Shepard. Motion Carried.

Storm Disaster Recovery. Mayor Visser gave council update.

Damon gave public works report.

Mayor Visser called the meeting to order at 6:37 p.m. Present were Spading, Svedja, Robison, and Rinderknecht. Shepard was absent. Also present were Damon and Groskurth.

Council held budget workshop. Council reviewed proposed Max Levy. No votes were taken at this meeting.

Svejda moved to adjourn budget workshop. Spading seconded. Ayes: Spading, Svedja, Robison, and Rinderknecht. Shepard absent. Motion Carried.

Council heard a presentation from Ryan Tang, Attorney, concerning the resignation of Councilor Shepard and options available to fill the empty seat on the City Council. The resignation is effective February 15, 2021. Spading moved to start the process to fill the vacant Council seat using the Council appointment option. Svejda seconded. Ayes: Robison, Svejda, Spading, and Rinderknecht. Absent: Shepard. Motion carried.

Svejda moved to approve Resolution 828 approving Minor Boundary Change for lots 303 2nd Avenue and 309 2nd Avenue, Atkins, Iowa. Robison seconded. Ayes: Robison, Svejda, Spading, and Rinderknecht. Absent: Shepard. Motion carried.

Rinderknecht moved to approve Resolution 829 approving Pay Request NO. 3 to Garling Construction for storm damage repairs. Seconded by Svejda. Ayes: Robison, Svejda, Spading, and Rinderknecht. Absent: Shepard. Motion carried.

Spading moved to approve Resolution 830 approving Employee Hire of Mike Rammelsberg to Public Works I position. Robison seconded. Ayes: Robison, Svejda, Spading, and Rinderknecht. Absent: Shepard. Motion carried.

Council discussed upcoming meetings for City Budget FY22.

Council discussed City Code Official (Inspector / Zoning Administrator) position. City will look alternate solutions.

Rinderknecht moved to set a special Council meeting February 25, 2021 at 6:30 PM for a Council work session to continue discussion on the City Budget FY22. Svejda seconded. Ayes: Robison, Svejda, Spading, and Rinderknecht. Absent: Shepard. Motion carried.

Mayor Visser gave an update on storm disaster repairs.

Damon gave a report of Public Works. Water Plant membranes arrived. Snowblower is valuable and used frequently. Discussed a snow ordinance option and parking in snow restricted streets.

Public input. Resident E.J. Bell discussed filling empty Council seat.

The next regular Council Meeting will be held Monday, March 1, 2021 at 7:00 PM, at St. Stephen’s Lutheran Church Fellowship Hall, 303 3rd Avenue. Due to the Governor’s Declared State of Emergency the Council meeting may be conducted using teleconference. Meeting agenda will include instruction to access the meeting.
