NOTICE OF PROPOSED ACTION TO INSTITUTE PROCEEDINGS TO ENTER INTO A LOAN AGREEMENT AND TO BORROW MONEY THEREUNDER IN A PRINCIPAL AMOUNT NOT TO EXCEED $4,500,000
(GENERAL OBLIGATION)
The City Council of the City of Atkins, Iowa (the “City”), will meet on June 28, 2022, at the City Council Room at 480 3rd Avenue, Atkins, Iowa, at 6;30 o’clock p.m., for the purpose of instituting proceedings and taking action on a proposal to enter into a loan agreement (the “Loan Agreement”) and to borrow money thereunder in a principal amount not to exceed $4,500,000 for the purpose of paying the costs, to that extent, of undertaking the replacement and improvement of a municipal fire station resulting from natural disaster-related damage to the prior facility.
The Loan Agreement is proposed to be entered into pursuant to authority contained in Section 384.24A and Section 384.24(3)(x) of the Code of Iowa and will constitute a general obligation of the City.
The maximum rate of interest which may be payable under the Loan Agreement is 7% per annum.
At any time before the date fixed for taking action to enter into the Loan Agreement, a petition may be filed with the City Clerk of the City asking that the question of entering into the Loan Agreement be submitted to the registered voters of the City, pursuant to the provisions of Section 384.25.3(a) of the Code of Iowa. If no such petition is filed, at the aforementioned time
and place, oral or written objections may be filed or made to the proposal to enter into the Loan Agreement. After receiving objections, the City may determine to enter into the Loan Agreement, in which case, the decision will be final unless appealed to the District Court within fifteen (15) days thereafter.

Mayor Pro-Tem Petersen called the meeting to order at 6:39 p.m. Present were Bell (online), Koehn, Petersen, and Stoltzfus. Also present was Groskurth, Eric Martin with Lynch Dallas. Absent was DeMeulenaere.
Petersen moved to approve the amended agenda by remove item #9 disaster insurance pay out. Seconded by Koehn. Ayes: Bell, Koehn, Petersen, and Stoltzfus. Motion carried.

Bell moved to approve Resolution 963 a resolution authorizing the Farmers Market to use the City Hall grounds located at 480 3rd Avenue contingent upon receiving certificate of insurance from entity. Koehn seconded. Ayes: Bell, Koehn, Petersen, Stoltzfus. Motion carried.
Koehn moved to approve 2nd reading of Ordinance No. 226 an Ordinance Amending the Code of Ordinance of the City of Atkins, Iowa, 2005, by Amending Provisions Pertaining to Water Rates. Stoltzfus seconded. Ayes: Bell, Koehn, Petersen, Stoltzfus motion carried. Stoltzfus moved to suspend rules and proceed directly to 3rd reading.
Koehn seconded. Ayes: Bell, Koehn, Petersen, Stoltzfus. Motion carried. Koehn moved to approve third reading and final adoption of Ordinance No. 226. Stoltzfus seconded. Ayes: Bell, Koehn, Petersen, Stoltzfus. Motion carried.
Stoltzfus moved to approve Resolution 964 a resolution setting the date for public hearing and additional action on proposal to enter into General Obligation Urban Renewal Loan Agreement and to borrow money thereunder. Koehn seconded.
Ayes: Bell, Koehn, Petersen, Stoltzfus. Motion carried.
Stoltzfus moved to approve Resolution 965 a resolution approving pay request 3 in the amount of $98,045 to Boomerang Corporation of Anamosa, Iowa. Koehn seconded. Ayes: Bell, Koehn, Petersen, Stoltzfus. Motion carried. Project removed 124 trees, trimmed 5, and ground over 4,000 inches of tree stumps.
Mayor’s Update and Public Works Update:
Continue to review reimbursement value with FEMA and Insurance for the fire station.
The city is aware of the FB pertaining to water coloration. City has been in contact with individual and IDNR. This occurs when fire hydrants are use.
